SMS & Employee Text Messaging Policy

This section describes how LADMA Traffic Control collects, uses, and protects mobile phone numbers and SMS consent in accordance with the Telephone Consumer Protection Act (TCPA), CTIA Messaging Principles & Best Practices, A2P 10DLC standards, and Twilio's Acceptable Use and Messaging Policies.

A. Program Description

LADMA Traffic Control may send SMS text messages to employees, applicants, contractors, and authorized workforce contacts for work-related and operational communications. Message categories include:

• Work Assignments & Scheduling — Job assignments, schedule updates, jobsite locations.
• Dispatch Instructions — Jobsite addresses, supervisor or point-of-contact information, reporting times.
• Safety Alerts & Compliance Reminders — Safety regulations, compliance updates, emergency alerts.
• Payroll & Billing Inquiries — Notifications related to payments, invoices, and time reporting.
• Company Announcements — Policy changes or operational information affecting employees and contractors.
• Training & Document Reminders — Certification renewals, document submissions, training updates.

B. Consent & Opt-In Methods

You may opt in to receive SMS messages from LADMA Traffic Control through any of the following methods:

• Verbally during onboarding or work discussions, with explicit confirmation
• By submitting an online form on our Website
• By completing a paper form during the hiring or onboarding process
• By providing written authorization on employment paperwork
• By providing your mobile number to LADMA for work communication purposes

SMS consent is used only for LADMA Traffic Control business, employment, dispatch, and operational communication. Consent is not a condition of employment or service except where SMS is the designated dispatch channel for active assignments.

C. Message Frequency

Message frequency varies depending on work schedule, job assignments, emergency needs, weather conditions, project updates, and operational requirements. Recipients may receive up to 20 SMS messages per week regarding job-related updates and safety notifications.

D. Standard Message & Data Rates

LADMA does not charge for SMS messaging, but standard message and data rates may apply based on your wireless carrier's pricing plan. Rates may vary depending on domestic or international messaging.

E. Opt-Out Method

You may opt out of receiving SMS messages from LADMA at any time by:

• Replying STOP to any SMS message you receive from LADMA
• Contacting LADMA directly to request removal from our messaging list

You will receive a single confirmation message acknowledging your opt-out, after which you will no longer receive non-essential SMS messages from LADMA. Because some messages relate to active work assignments, safety, scheduling, or emergency operations, employees should also notify LADMA management or HR if they no longer want to receive work-related messages so an alternate communication method can be arranged.

G. Re-Subscribing

If you previously opted out and wish to resume receiving SMS messages, reply START or UNSTOP to a previous LADMA message, or contact LADMA directly to re-subscribe with renewed consent.

H. SMS Privacy & Data Protection

• We do not sell or share SMS opt-in data or phone numbers with third parties for marketing purposes.
• Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes.
• We share phone numbers with third-party service providers only as necessary to facilitate SMS communications (for example, Twilio as our SMS delivery platform, payroll providers, or scheduling systems) under strict confidentiality and data-protection obligations.
• SMS consent records and phone numbers are stored securely and accessed only by authorized LADMA personnel.

I. Eligibility

SMS communications are available to individuals who are at least 18 years of age and who have provided a valid mobile number to LADMA for employment or operational purposes. By providing your mobile number, you represent that you are the authorized account holder for that number or have permission from the account holder to receive messages.

J. Carrier Disclaimer

LADMA Traffic Control is not liable for delayed or undelivered messages. Carriers are not liable for delayed or undelivered messages. SMS service is provided on an "as available" basis and may be subject to interruption due to factors outside LADMA's control.

9. Changes to Terms. LADMA reserves the right to modify these SMS Terms & Conditions at any time. Continued participation in SMS communications after changes are posted constitutes acceptance of the revised terms.
10. Governing Law. These SMS Terms & Conditions are governed by the laws of the State of Maryland and applicable U.S. federal law, including the Telephone Consumer Protection Act (TCPA).
